NCGOP Files Amicus Brief in Fight Against Unconstitutional Candidate Challenges

The N.C. Republican Party filed an amicus brief and motion in federal court seeking to uphold the Constitution and the Rule of Law pertaining to challenges of Congressman Madison Cawthorn’s candidate filing. Read the brief and related filings here.

The State Board of Elections has once again exceeded its Constitutional authority by usurping the authority of Congress to make such determinations. This brief and motion is filed in defense of this Constitutional process.

“The Constitution specifically grants Congress the power to determine who is qualified for congressional office, not the state board of elections,” said NCGOP Chairman Michael Whatley. “As much as the Democrat activists on the State Board want to smear Representative Cawthorn, the fact remains there is absolutely no basis for them to claim this authority.”
