Chairman Dan Barry called the committee to order.
Chairman Barry began by asking several questions:
1) Should the Executive Committees have the power to censure or reprimand? The answer
is yes.
2) Should the target have the right to defend themselves? The answer is yes.
3) Should there be a supermajority (2/3) supporting censure? The answer is yes.
4) Should the supermajority be of the entire membership? The answer is yes.
5) Should the supermajority of those present and voting be required? The answer is yes.
6) Should the censure be appealable? The answer is yes.
Mike Phillips stated that there should be a special notification provision of not less than five or
ten days.
Chairman Barry asked if this should fall into a category of a special meeting. The consensus is
yes.
The discussion on censure continued from last week.
The other question that was asked was should Johnston County be allowed to censure or do a
resolution of disapproval of the Mecklenburg County Sheriff. The consensus is no. This would
only be involved if the target is a member of their own committee.
Mike Magnanti presented a motion to allow votes of discipline may be taken with a 2/3 vote of
the membership to adopt. Roberts Rules of Order Chapter 20 will be the Censure Guidelines. Bob
Castona seconded the motion. There were several concerns about any new censure provision
being weaponized, the language being too broad, and the possibility of doing long term damage
to the overall organization. It was also pointed out that Resolutions of Disapproval can be done
by anyone at any time. The motion failed on a 4-8 vote.
There was a follow up motion by Mike Phillips and seconded by Bill Scholtes that would adopt
language for a Resolution of Disapproval. The definition would be a condemnation of anyone
other than a member of the same committee proposing the resolution. This is the only limit as to
who the subject of the resolution of disapproval may be. Requirement for adoption is the presence
of two-thirds of the membership for a County Executive Committee in addition to two-thirds of
those present at a District or State Executive Committee. The subject of the resolution would be
allowed to follow the same procedure as outlined for Censure. The motioned passed with one in
opposition.
Mike Magnanti made a motion to provide for censure with the following provisions:
1) Censure is defined as a written condemnation of a member of the same committee
proposing the Censure.
2) Causes defined include: Failure to fulfill responsibilities, mismanagement of resources,
ignoring ethical standards, party disloyalty, opportunistic candidate
3) Threshold for adoption will be 2/3 of the membership of the County Executive and 2/3 of
those present of the District and State Executive Committee.
4) There is an eight step process for appeals.
The motion was seconded by Michael Owens.
After considerable discussion, Marshall Conrad moved to amend the motion to remove the
language that the definition of party disloyalty includes an elected official for supporting
legislation that would be counter to the North Carolina Republican Party platform. The motion
was seconded by Bill Scholtes and carried unanimously.
After further discussion, the original motion failed 4-12.
Chairman Barry reminded the committee that this is not the final product, and this issue can be
revisited.
The discussion pivoted to the subject of involvement in primaries. The proposal is to allow
involvement in a primary if and only if a candidate was previously censured.
Hunter Clark moved the language for the proposal to be adopted. Michael Magnanti seconded the
motion. The motion failed on a 4-12 vote.
A motion to adjourn was made by Harvey West, seconded by Ed Stiles, was approved.
